The Federal Trade Commission has imposed new regulations for physicians, hospitals and other healthcare providers to develop and implement secure identity theft protection programs by August 1, 2009. Harsher governmental regulations, vigilant monitoring and stricter enforcement elicit concerns of claims activity, as state attorneys general gain new authority to initiate civil lawsuits under federal law; common exposures are Billing (including fraud and abuse allegations, Medical Board, Staff Privileges, HIPAA, DEA, EMTALA and STARK.

Florida statutes require that Ambulatory Surgery Centers (ASCs) establish and maintain an internal risk management program with components including continuing education and training of personnel, ongoing risk evaluation, patient grievance processes, and incident reporting.
